This Addendum relates only to our Linux, Windows, Email Only, Domain Parking and Reseller shared hosting products. They do not relate to any other product or service supplied by PCGuys unless specified herein.
1. Definitions and Interpretation
In this Service Schedule the following expressions shall have the following meanings unless the context otherwise requires:
"Agreement" - means The Resellers Agreement in full referenced above, inclusive of all addendums, attachments, relevant terms, applicable application form and Acceptable Use Policy;
"Commencement Date" - means the date when the Customer first receives the live Service.
"Customer Apparatus" - means apparatus belonging to the Customer not forming part of the Equipment but which may be connected to the Equipment;
"Equipment" - means any apparatus or equipment provided by PCGuys or any third party to the Customer at the Premises to enable provision of the Service;
"Minimum Period" - means (a) thirty (30) days unless otherwise stated within this addendum;
"PCGuys System" - means the Hosting system which PCGuys runs, and, for the purpose of this Agreement, any apparatus leased by, or otherwise obtained by PCGuys, from a third party;
"Person" - means an individual or a body corporate or unincorporated or a partnership and "Persons" shall be construed accordingly;
"Services" - hereafter and related to this addendum mean those manual and automatic Hosting and all related services as described on the date hereof and within the Company's website pcguystelecom.com together with any additional services of such a nature that may be provided by the Company;
2. General
2.1. References to clauses and sub-clauses, unless specified otherwise, pertain to those within this Agreement.
2.2. The headings in this Addendum serve merely for ease of reference and do not influence the interpretation of this document.
3. Provision of Service
3.3. PCGuys will deliver the Service to the Reseller under the stipulations of this Agreement, including any addenda, and according to the Terms and Conditions available on the PCGuys website concerning the reseller's customers.
3.4. We commit to making all reasonable efforts to provide the Reseller with continuous access to the Server and the Services as outlined in this addendum.
3.5. Except as explicitly allowed in these Conditions, and subject to further limitations herein, the Reseller is prohibited from:
3.5.1. Assigning the Service usage rights, in whole or in part, to any third party;
3.5.2. Disclosing Service particulars, bugs, or viruses to any third party without PCGuys' prior written approval;
3.5.3. Utilising the Service in any manner other than with the operating environment recommended by PCGuys, or altering the Service without PCGuys' express written consent.
3.5.4. PCGuys retains the authority to modify the Customer's password at its sole discretion.
3.6. PCGuys reserves the right to suspend the Services at any given time and for any reason if considered necessary, without prior notification.
3.7. PCGuys may need to temporarily disrupt the Service or alter its technical specifications due to operational requirements or emergency situations. PCGuys will endeavour to provide the Reseller with as much notice as possible of any planned disruptions. PCGuys will not be liable for any Service interruptions or Server downtime, whether caused by PCGuys or third-party actions. Under such conditions, the Reseller shall have no claim against PCGuys for any such interruptions.
4. Website Hosting & Email
4.1. PCGuys does not represent or warrant the accuracy or quality of information transmitted via the Server and accepts no liability for any loss or damage to data stored on the Server.
4.2. The Reseller is obligated to use the website provided by PCGuys lawfully and guarantees to PCGuys that:
4.2.1. No upload, posting, linking to, or transmission will occur involving:
4.2.2. Unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane, racist, or objectionable content.
4.2.3. Material that constitutes or incites criminal activity, infringes intellectual property rights, or violates any rights under the law of any jurisdiction.
4.2.4. Content prohibited by PCGuys' acceptable use policy.
4.3. Bulk email, either opt-in or otherwise, must not be sent from our network, nor should a site hosted on our network be promoted via bulk email.
4.4. Programs consuming excessive system resources, such as processor cycles and memory, are not permitted.
4.5. Uploaded files should solely facilitate website and web application operation and management.
4.6. PCGuys may remove any content deemed inappropriate from your website without prior notice.
4.7. PCGuys may delete scripts that excessively consume system resources.
4.8. The Reseller must comply with prescribed procedures, ensuring their use of the Server does not negatively impact other customers.
4.9. All email communications must adhere to applicable legislation and be securely sent.
4.10. Individual Resellers must be at least 18 years old; for companies, the Services must not be used by anyone under 18 years of age.
4.11. Access to external networks via PCGuys must conform to the rules of those networks.
4.12. The integrity and security of the Server are prioritised, but PCGuys cannot guarantee immunity from unauthorised access or hacking, with no liability assumed for email misrouting or non-receipt.
4.13. PCGuys will back up data on its shared hosting platform but is not liable for data loss. Resellers should maintain their own backup processes.
4.14. Websites using excessive system resources, affecting PCGuys' platform performance, may be suspended. Suitable alternatives will be suggested upon such suspensions.
4.15. The Reseller assures that due diligence regarding domain name ownership has been conducted, adhering to Ofcom's regulations and terms.
4.16. Internet Protocol addresses provided by PCGuys remain its property, with the Reseller granted a non-transferable licence for the Agreement's duration, which terminates upon its conclusion.
5. Data Storage and Integrity
5.1. The Customer acknowledges and agrees that any data stored, transmitted, or processed on PCGuys' servers is done solely at the Customers own risk. PCGuys shall endeavour to maintain the integrity and security of such data, however, it does not guarantee the continuous integrity of the data or the availability of backups. The Customer is responsible for maintaining adequate and regular backups of their data to prevent potential loss or corruption. In the event that a customer pays for a backup service and said backup becomes corrupted, ceases to function, or proves incapable of restoring any data, PCGuys shall reimburse the customer the equivalent of one month's backup service subscription fee.
6. Email Service Monitoring and Access
6.1. As part of our commitment to provide reliable and effective email hosting services, PCGuys reserves the right to access customer mailboxes hosted on our servers. This access is solely for the purpose of diagnosing and resolving issues, maintaining system integrity, and ensuring the continued performance of the email services.
6.2. Access to mailboxes will be exercised only when necessary and will be limited to actions required to resolve issues or to perform system maintenance and upgrades.
6.3. The legal basis for accessing customer mailboxes under this policy is our legitimate interest in ensuring the effective operation and security of our email services. This access allows us to identify and address issues proactively, maintain service quality, and prevent system disruptions.
6.4. By using our email hosting services, customers agree that PCGuys may access their mailboxes as described herein without obtaining further explicit consent for each instance of access.
6.5. PCGuys is committed to ensuring the confidentiality and security of all data accessed during the course of service maintenance and issue resolution. We implement stringent security measures and protocols to protect customer data against unauthorised access, disclosure, or misuse.
6.6. Access to customer mailboxes is restricted to authorised personnel.
6.7. PCGuys will maintain transparency regarding our access practices through our Service Agreements.
6.8. Customers who have concerns or require further clarification about our mailbox access practices are encouraged to contact our team via e-mail. We are committed to addressing all inquiries and providing additional information upon request.
7. Bandwidth / Data Transfer / Mailboxes
7.1. Despite being advertised as unlimited/unmetered, PCGuys enforces a fair usage policy for data transfer exceeding 100GB per month per website.
7.2. Email size is capped at 25MB on the shared hosting platform to prevent system abuse.
7.3. POP3 mailboxes impose no size limit, but PCGuys may close mailboxes that overuse system resources. Emails are removed after thirty (30) days if read, while unread emails stay for ninety (90) days.
7.4. IMAP mailboxes have a specific disk space limit.
7.4.1. Exceeding this quota results in bounced emails.
7.4.2. Unlike POP3, IMAP emails do not have an expiry period.
