PCGuys Telecom - Fax Services Schedule for Resellers

This Addendum relates only to our PCGuys Fax products. They do not relate to any other product or service supplied by PCGuys unless specified herein.
1. Definitions and Interpretation
In this Service Agreement, the following expressions shall have the following meanings unless the context otherwise requires:
"Credits" - means pre-paid credit tokens which can be used for the transmission of faxes;
"Email to Fax" - means the ability to send faxes without the use of a fax machine. The authorised user of the service sends an email to our system. The contents of the email and supported attachments are electronically read and transmitted to the recipient fax number. Each page sent has a credit value which is deducted from a pre-paid pot of credits.
"Fax to Email" - an inbound UK fax number, designed to receive faxes worldwide and those successfully received faxes will be emailed to the subscriber as a PDF attachment. An annual subscription is applicable for the rental of the inbound number and fax to email conversion service. There are no additional charges to receive faxes regardless of volume.
2. Supply of Services
2.1. PCGuys provides no assurances and accepts no liability regarding the usage, accuracy, or quality of information transmitted or received through the Fax Services, nor for any data loss or damage incurred during such transmission or storage.
2.2. Should any account remain active but with unused credits after a period of twenty-four (24) months, PCGuys retains the authority to annul these credits without issuing refunds.
2.3. Typically, one message credit is consumed for each page delivered or attempted to be delivered to a UK landline. The credit cost per page for international destinations varies and is detailed on our pricing pages. PCGuys reserves the right to apply additional charges or deduct credits to cover internetworking or termination fees incurred. Changes to the credit cost structure can be made by PCGuys without prior notification.
2.4. Message credits are non-refundable. If an inquiry into non-delivery is needed, the customer agrees to bear any administrative costs incurred. PCGuys may estimate these costs, charging them in advance, with adjustments following the actual expenditure incurred. Investigations will not lead to credit refunds for failed message deliveries.
2.5. The Services may occasionally be unavailable due to external factors beyond PCGuys' control, such as adverse weather conditions, power outages, or failures in ISP or broadband connectivity. In such events, all Services will be similarly affected and unavailable.
3. Acceptable Use
3.1. You represent and warrant that you have obtained consent from the recipients of messages sent through PCGuys services, complying with any applicable legal or regulatory requirements. You must include clear instructions for opting out in your messages as required by law and conform to the Consumer Best Practices Guidelines of the Mobile Marketing Association, where relevant.
3.2. You are obliged to acquaint yourself with and adhere to all pertinent local, national, and international laws and regulations, taking full responsibility for all activities under your account, including the content of messages sent through the PCGuys Services. 3.3. Be aware that various laws and regulations at national and international levels may restrict certain types of Fax messages. PCGuys' provision of services is based on the assumption that you are compliant with these legal requirements, and it is your responsibility to ensure the legality of your communications.
3.4. Schedule your message broadcasts considerately, in compliance with appropriate local, national, and international timing regulations. You are responsible for securing any necessary rights or licenses for the content included in your messages. If unsure about the legality of your message content, seek legal counsel prior to using the PCGuys Sites or Services.
3.5. The PCGuys Services are strictly for professional use. Prohibited uses include:
- Sending unsolicited marketing messages or spam.
- Collecting information about individuals without their explicit consent.
- Misrepresenting the identity of the message sender or using false contact details.
- Transmitting any unlawful, harmful, or objectionable material, including but not limited to racist, libellous, abusive, or sexually explicit content.
- Infringing on any third party's intellectual property rights.
- Distributing malware such as viruses, trojan horses, or worms.
- Violating network usage policies or disrupting network services.
- Attempting unauthorised access to the Services or associated networks, through password mining or any other means.
- Conducting any activities that could subject PCGuys to legal liability or penalty.
